TERMS AND CONDITIONS
It is your responsibility to read this agreement carefully and to understand your rights and obligations before you contribute to the Donation Program offered by My Place of Donation herein, (MPD). MPD allows consumers to give various electronic devices that will be refurbished or resold for charitable purposes. MPD will donate a portion of the proceeds to an organization of your choice. MPD reserves the right to alter, cancel, or amend its services at its discretion.
By participating in the MPD Donation Program you are accepting the terms & conditions outlined below.
I agree to the following terms and conditions of the MPD Donation Program:
1. I understand, MPD accepts donations on behalf of each respective organization and refurbishes my donated electronic device and gives a portion of the proceeds to the organization of my choice. The "portion" of the proceeds will be determined by agreements established between MPD and participating organizations. Any electronic device and accessories that cannot be refurbished or sold will be properly recycled within the guidelines of state and local regulations.
2. Though I am aware that MPD takes all reasonable precautions to protect my privacy, I acknowledge that I am exclusively responsible for any personal information stored in the hard drive or otherwise for the item donated.
3. I understand that MPD is not responsible for removing information from my item and cannot guarantee that all information left on my item will be deleted. It is my responsibility to delete any information from my item before it is donated to MPD.
4. I declare I am the rightful owner of the item being donated to the Donation Program. I possess the exclusive right, license, and privilege to transfer ownership to MPD.
5. I understand that no compensation will be given to me directly and that only MPD and the charitable organizations associated with the Donation Program will receive any portion of the proceeds.
6. I understand that the condition of the item when it arrives at the MPD warehouse is exclusively my responsibility.
7. I agree and understand that the donated value assigned to the item after its receipt and inspection by MPD is final and non-negotiable. This value may be less than the estimated value I have been provided and may be zero. I further acknowledge that under no circumstances will the item I have donated be returned to me even if I am not satisfied with the donated value or if the donated value is zero.
8. I understand that if the item does not have a valid, visible Electronic Serial Number (ESN) or International Mobile Equipment Identity (IMEI) number, the final donated value after its receipt and inspection by MPD may be reduced to zero.
9. I understand that if the item has water damage or corrupt software, it is considered a non-operable item and may be valued at zero.
10. I understand and agree that all data stored on the item may be deleted and will be unrecoverable.
11. I understand that it is my responsibility to discontinue service such as GPS, web browser or other that may require periodic payments on any item(s) I am donating before sending the item(s) to MPD.
12. Upon MPD’s reception of the item I have donated, I agree to transfer all right, title and interest of the item to MPD.
13. I agree to ship the item to MPD within 30 days of the day I agree to donate my item or within a reasonable amount of time.
14. I understand that MPD has not made any representation that the donated value assigned to the item is equivalent to its current advertised value and that all values assigned are based on the discretion of MPD.
15. I agree that MPD and its affiliates and partners will not have any liability to you in excess of the final donated value assigned by the Donation Program. In no event will MPD or its affiliates or partners be liable for any indirect, consequential, punitive, incidental or exemplary damages, whether foreseeable or unforeseeable, even if we have been advised of the possibility of such damages, arising out of this agreement.
16. To the fullest extent permitted by law, I agree to settle any dispute with respect to the Donation Program by arbitration governed by the Federal Arbitration Act in the city of Los Angeles, CA at the offices of the American Arbitration Association and that I am personally responsible for all costs associated with any such proceedings.
17. I acknowledge that all personal information provided to MPD is in connection with the Donation Program solely and will not be shared with a third party for any marketing efforts other than information related to the Donation Program. If you do not wish to have your information used in this manner, please contact MPD at info@myplaceofdonation.com to be removed from the Donation Program mailing list.
18. I understand MPD has the right to amend or change these terms and conditions from time to time in compliance with any changes to local, state, or national statues, regulations, or otherwise.
